I know I'm asking a pack of one armed monkeys in a room full of two fisted beer steins but here goes:
I made a website for someone in April. I gave them 60 days to pay. In June I ask if the cheque was ready to which I got an email saying cash was tight, could I wait? I responded by saying sure...another 30 days is cool and if they needed, they could break up the invoice. Nothing. July. Nothing. August. Nothing. September, a couple emails and a promise to have something on my desk by first week in Oct. Nothing. So this evening I went and changed the passwords to the site and emailed asking when they could pay me (but didnt mention the password thing).
If they dont respond, I suppose I have to take them to small claims and stand in front of Judge Judy, which sucks because Judge Judy up here in Canada is actually a polar bear with a flashlight strapped to his head.
I changed the passwords only so that I could protect my work. It's their site but we have a verbal agreement that I'm the webmaster, and hence, the content is still mine until they shuck out the cash.
Or am I wrong?

Not at all DR. If they don't pay you (unless your contract says otherwise) you are in complete control of the site. Hell, you COULD put goatse on the front page until they pay you. Then again...I'm a napkin.

You should add a page to their site with a link for donations to paypal and keep the funds.
That sucks and sucky people suck.
I wanted to clarify something . . . do they owe you $60 per month and have not bothered to pay you any of it, or was it a one time charge of $60?
If it's the one time deal, will any court costs be higher than that amount?
I hate injustice and if I have to wear my Toy Story bedsheet cape into Washington, I'm getting some damn laws changed here!

I had the same situation, only I was the customer and my friend was the webmaster. (INTELLECTANDEMOTION.COM)
We didn't even have a set amount or payment date, he walked up one day and asked for $50, which I gave to him.
Don't goatse for another month, just take it down for now; and after that, Emersons for everyone!

I used to do free-lance stuff (not web-design but so what--same issues). I think you should try to shut down the site if possible until they pay. If you can't, Goatse them (or Tubgirl).
I would also advise making people pay before they get the product, or at the time of receiving the product. I learned the hard way that once they have what they ordered, they don't give a Shakespeare about how long you have to wait to get paid. Other bills always come first.
People basically have no morals. They can't do something themselves, so they hire someone else to do it, but then they totally underestimate the amount of work that went into it and don't want to pay.
I don't do custom work or commissions anymore for that reason. Unless, like I said, I get the money up front.

I generally do get money up front (at least a third) before I even open up photoshop. The reason Im a bit stymied is that we've had a great biz relationship before this. These guys have never been late with other projects I've done for them (print and web) in the past and as far as I can see, they've actually grown since the spring.
Do remember that they are the ones who own the domain and server space. The only legal thing I could do is just wipe the site, not add anything to it.
Though Tubgirl would rock...its a diner and to have their customers call that up would certainly make them lose their appetite. Or triple their triple-thick orange milkshake production.

Is the customer in any danger of going belly up ? I don't know if it applies to products of that nature, but with hard goods, once billed it is their property, and even if you are wharehousing the goods, they still have the right to the product and it get's dealt with as an asset and creditors like the IRS and Banks get first crack at anything of value.
My buddy shipped Maycy's $30,000 in cheap Hong Kong electronic gift items right as they went chapt. 11 and they were not obliged to pay a cent for almost a year.
Even worse, there is about a 35% defect rate with Shakespearety electronic do-dads, and he had to accept and refund cash for items he was never even paid for.
I can't imagine you getting in too much trouble, as long as you resist temptation to defame or slander them.

FYI: Yesterday I recieved 1/2 payment by mail. Zip. Cheque goes into the bank. Clears! (does feild goal arm thingy) It had a note saying the other half was on its way.

Actually, the smart thing would have been to have the site go down "accidentally" so that they need you to put it back up. When they call, you tell them you have a customer who pays who has to be first in line. Just put it back up when the check(que) clears.
